Can't create a new brush from images with gradient fill
I was trying to create a new pattern/scatter brush.
Unfortunately I discovered that an image with the gradient fill can not be used to design a new pattern brush. The fill color must to be always solid. So, my new pattern brush is always simple.
Has anyone made a pattern/scatter brush based on an image with gradient-fill?

As far as I know, Illustrator (even CS) will not allow you to create a pattern or scatter brush from an object that contains a gradient or mesh.
However, depending on what you're trying to achieve, you CAN blend two objects together to simulate a gradient and use that. Or, simply "expand" a gradient object and then use that as the object to base the pattern brush.
