Icon Copyrights - Mac Programming

Hi, I want to use a picture of a SmartMedia card as an icon for my program's files. Does anyone know if there would be any legal problems from the company who created SmartMedia cards? thanks Jeff...

    Default Icon Copyrights

    Hi,

I want to use a picture of a SmartMedia card as an icon for my program's files.
Does anyone know if there would be any legal problems from the company who
    created SmartMedia cards?

    thanks

I, but here's some simplified guidelines, as far as I remember them:

-> If you didn't take the picture yourself, and you haven't explicitly
bought the rights, the photographer will have the right to sue you

-> If the picture is of a particular product, or contains a company
logo, the company will have the right to sue you. After all, people see
the icon and may think your product has something to do with that company

-> If there are any people on pictures you're using, and the picture
doesn't show them simply as part of a public place, but rather shows a
particular person or group of people, you have to ask them for their
    permission.

-> If the picture shows people on their private property you have to ask
    their permission.

The safest technique is usually to make a generic icon in such cases.
Look at SmartMedia cards from various manufacturers, and create an image
yourself (best draw it instead of using a photo, that way it's artistic
interpretation) that has only the characteristics all of them have, and
don't put any logos or anything like that on it.

But if your program doesn't even work with SmartMedia cards, that may
    not be enough.

But again, I, so ask your lawyer to be sure. I tried to err on the
    side of caution.

    Cheers,

If you poke around on kdelook.org, or themes.freshmeat.net, you'll
likely find some icon sets that are GPL'd. I'm sure there are some that
contain SmartMedia card icons, but I can't recall offhand which ones.
