InDesign & Indesgn CS Spellcheck problems

We have several documents (Templates created in CS and exported as Indesign 2 documents for editing) where spellcheck is not working - the documents have a comments layer (normally hidden) and the main document layer itself.
When you run spell check it just checks the background (comments) layer, not the actual document itself.
Are the documents corrupt, or is this a bug in the software? Or is the problem because of differences in Indesign CS (which the communications dept uses) and Indesign 2.0.2 (which the PA's use to modify the document)?
