I was curious about this too. I tried the AI Legacy EPS and it worked great... layout and layers, images and everything were undisturbed. I just had font problems only cause the OS9 didn't carry the font in my FontReserve. I didn't try just the AI Legacy... wonder if making the extra step in EPS world helped out a bit making it more versatile to open.
Just a notion... I'm sure it does depend on how the file was built, embeded images, etc. But, it's worth every try when it comes to compatibility issues. You gotta get done what you gotta get done. I'm in an office with everone on OSX except me.

I didn't try to AI Legacy EPS, if it works I am definitely going to give it a try. On the part about embed images, I don't do that. So that can't be the problem.

I've same problem as you do, I simply use AI 9.0.2 running in Classic for projects where my client haven't updated. If you have a registered version of Illustrator 9, you could install it in Classic, and you wouldn' have to worry about text heritage, MacOS9/OSX font compatibility or other functions that don't translate back in history.
I simultaneously run Illustrator 9, Quark 5 in classic, and Photoshop CS, without any trouble, but that depends on the system you have. It sounds like a cop-out but I don't have any headaches working like this.
Still, you had some very good advice above, which I've noted for myself.

OS9.2.2 and AI10.03
I have recently had a few cases of customers sending what I think are AICS files, but I could be wrong.
When I open it in AI10 it says newer version needed, but if they send a .pdf I can open it in Acrobat and using PitStop. As long as I can select text I can export it as a .ps or .eps and open it in Illustrator. But the text is broken up as with convertion from other programs. You need the font installed to successfully save this file.
Or just open a new AI file and try to place the file you want.
Or if it's an .eps and you have Quark try placing the file in that document and then saving as an .eps and then converting it to AI.
No real answers, sorry. Just know that I can use some files that say "In a newer version".
