Default Serious ibook problem - Advice needed

    All,

I purchased a refurbished ibook online last week and it has some
    serious quality defects:

    - It latches only 20% of the time and pops open often

    - The keyboard is 'bowed'

    - The battery isn't flush and the unit wobbles when I type on a table

    - The screen is not aligned with the base when shut (likely causing
    said latch problem?)

    - With the keyboard removed, you can see the "foil" of my CD-RW
    warped.

I took it to the AppleStore yesterday (I bought it online at
Expercom.com) to make sure I was on-base and they said, "I am ashamed
    you received this ibook."

I called the Vendor, who has no refurbished models available for
    exchange.

I called Apple and they of course can offer to fix (but not replace).

My question: I've had my Apple for 3 days. Its a lemon. If all these
things are wrong - what else might be? I don't want it fixed, I want a
different one. Anyone have any suggestions on how to proceed with
Apple/Applecare, or should I eat the $50 restocking fee and just buy a
    (cheaper too) Dell Laptop?

Thanks in advance for the advice,

    Ryan

If Apple's offering to fix all your defects, give Applecare a chance.
YMMV, but I've had excellent and timely service with both of our iBooks.
See if you can find anything else to complain about before you send it
in. At some point, it's cheaper for Apple to send you a different unit
than fix the one you sent, which is what you want anyway.

You could eat the restocking fee and buy a Dell, but then you'd have
a Dell instead of an iBook. Aside from being heavier, uglier, hotter,
and running an inferior OS, in my experience they aren't nearly as rugged
    as the iBooks.

If you purchased it on a credit card, dispute the charge with the credit
card company. This usually gets the vendor's attention really quick.

    Ryan,

First, check with the warranty to see what they can do for you. If
it's a refurb model with Apple warranty protection, use it to the
    fullest.

Second, congratulations on your poles and your victories on the NASCAR
Winston Cup tour this season. You are truly a rising star in the
    sport.

(Oh, wait, you're not THAT Ryan Newman? Sorry...) ;-)
