Unwanted mc instances - Macromedia Flash Actionscript

Hi all I hope I'm not posting this twice but it didn't seem to work first time. Apologies just in case. And next time I'll copy my carefully composed post so I don't lose it! I have a single level movie. Frame 1 is an intro screen, Frame 2 is where I initialise for Frame 3 which is where drag and drop activity takes place - dragging food items to a plate.     Hi all
    I hope I'm not posting this twice but it didn't seem to work first time.
    Apologies just in case. And next time I'll copy my carefully composed post so I
    don't lose it!

    I have a single level movie. Frame 1 is an intro screen, Frame 2 is where I
    initialise for Frame 3 which is where drag and drop activity takes place -
    dragging food items to a plate.

    I want the food item being dragged to appear above all the others until
    another food item is dragged to the plate thereby naturally sitting above the
    first. I'm using mc.swapDepth(5) - 5 is arbitrary - to accomplish this and it's
    giving me more or less the desired result.

    However, what's happening is: if you drag, say, fish to the plate then click
    Back (to intro), a 2nd instance of the fish appears on the intro screen (it
    shouldn't be there) in its initial x/y location. Then when you click Next, the
    2nd instance of the fish is still there. If I drag two items to the plate and
    click Back, the later item is on the intro screen and the 2nd fish has gone
    both from the intro screen and the activity screen, BUT the later item is now
    duplicated on the activity screen.

    Can anyone shed any light? Am I misusing swapDepth() - my feeling. How should
    I be doing it?

    It sounds like this is happening:

    1) When the clip starts flash has placed the fish clip at its default level
    (e.g. level 2)
    2) In frame 3 it gets put at depth 5 (not on 2 anymore)
    3) When it goes back to frame 1, flash places the fish at its default level 2,
    and there is still one at 5
    4) When you get to frame 3, you drag the fish and it SWAPS depths with 5 and
    there are still 2 fishes, the first at level 2 again, and the latest at level 5
    5) When you go back to the intro screen the latest is there still at level 5,
    plus a new one again at level 2
